The taking of a polygraph test has always been regarded as quite a contentious issue. Many stress that the basic rights of privacy granted to workers are violated as a result of taking the test. Apart from that, the results of polygraph tests might be compromised in a variety of ways. Considering this, they are unreliable. Still, the presented paper aims to apply the laws to polygraph use and privacy in relation to the case study at hand involving a fired employee who refused to take a polygraph test after his locker had been searched and drugs revealed.

As for the employers right to conduct a polygraph test, it should be asserted that the Employee Protection Polygraph Act of 1988 provides that an employer may force an employee to pass the test in case it relates to the investigation of criminal or other misconduct. In the presented case, the employee was accused of keeping drugs in his company locker. However, the case study did not mention that the employer had provided the employee with a written notice at least 48 hours before the test taking time. In this written notice, he should have stated the reasons for submitting the employee for a polygraph test.

The Employee Protection Polygraph Act of 1988  also provides that the information that had been revealed during the test cannot be disclosed to others by anyone except for the examinee. At the same time, a polygraph examiner may indeed disclose the data collected during a polygraph test to court, an agency, an arbitrator and other persons as provided by the laws, pursuant to the order from court of the specific jurisdiction. Based on that, it should be underlined that the information can be disclosed only in case a court order has been issued. Otherwise, the obtained evidence will not be admissible in court. Therefore, the employee should not have been concerned about the publication of the results of the polygraph test and its impact on the custody matters.

At the same time, it should be noted that the refusal to take a polygraph test in this situation had resulted in the firing of the employee. In accordance with the Employee Protection Polygraph Act of 1988, such actions of the employer are unacceptable. The Act clearly articulates that the testing cannot be regarded as a condition for employment. Therefore, the employer cannot take disciplinary actions or fire a person. 

Furthermore, Worker Adjustment and Retraining Notification Act (WARN Act) of 1988 declares that employers with 100 or more employees are obliged to provide them with the written notice of labor relations termination 60 days prior to the mass layoff. Such term must be given to all workers to help them and their families to prepare for the harsh times ahead. In this case, the terms had been violated and the employee was informed of his firing untimely.

In conclusion, it should be emphasized that the labor rights of the employee in the given case were disrespected several times. First of all, the employee was indeed subjected to taking the polygraph test due to the drugs found in his locker. However, the employer should have proved that there was an investigation of the crime. Secondly, the employer had no right to fire the employee because of his refusal to take the polygraph test. Moreover, no disciplinary measures should have been taken in this case. Additionally, the employer was supposed to provide written notifications regarding the passing of the polygraph tests and the lay-off. None of those were presented to the employee. Concerning the employees fears about the loss of the custody, caused by the results t of the polygraph test, it is worth repeating that the information regarding the test can be disclosed only on the basis of court order. Therefore, in this case, the employee has a range of reasons to seek legal protection based on the current laws.

Driving Phobia

Hello, All

My name is Jasmine and I am new on here. The reason why I am on here is because, I am to the point that I want to overcome my fear of having driving phobia. I don't really drive like that because I have a total fear of accidents and anxiety behind the wheel. Yesterday, I drove long distance. I was really calm, but also I was kind of scared because I haven't drove in 9 months. I was really doing good until I had to stop at a light and I swerved a little bit. I don't know why I swerved because I never done that before when stopping at a red light. I felt bad a little bit, but then I got over it. Also, when I was driving I felt like pulling over and let my fiance take over, I had continue driving because I know I can do it and that I want to face this fear. After we made it home safely, I shook that feeling off and I told my fiance I can't believe I drove. He told me that I did just fine. Another thing, when I am on the passenger side, I be scared sometimes because I think something might happen. I am ready to overcome all this driving phobia, because I can't let other people drive me to places that I need to be. I need to start driving myself and not only that I am moving to the city the 27th, so yall know that I need to get my driving back in check. I forgot to tell yall that if someone is so close behind me I tend to get nervous and speed up. In my mind, I guess I feel that if the other drivers don't like the speed that I am going, I want to speed up and go the same speed as them, but I know I don't have too. A few years ago, I had gotten into this accident with some friends, when the two people was playing around and the person on the passenger side yanked the wheel and we flipped maybe 2 or 4 times, and after that I been scared every since so I'm thinking that's where this driving phobia came from. I hope I get over this driving phobia because I need to drive and I can't let this bother me forever. I know my fiance get tired of driving at times, so I want to be able to take over.

When I can't sleep

So one night I can't sleep and a game just came into my head. Might sound wierd when I explain it in a second, but puts me to sleep most of the time. So if you want to try it here it goes.

 

You have the alphabet A-Z as we all know.

Chose a subject, which can be as broad or narrow fielded as you like. Such as country names or character names from a certain movie.

This is where the alphabet comes in. Starting at A, think about something begining with that letter that relates to your subject you chose. Then work your way through the rest of the alphabet in order.

 

I know it hard to explain on here, so let me walk you through an example to help.

Lets start by chosing our subject, say fruit. Starting at the letter A, we could say Apple. Then we move to B, might say Banana. Repeat this for every letter that you can, progressing towards Z. If you got through the alphabet then do another round, chosing a different subject.

 

Ok now lets run through a broad subject like geograpghy. Say we progressed to the letter F, we could say forest, as it is related in some way. Then repeat again like the other example.

 

So there it is, like I said it works for me most of the time. Might have to do a few rounds, but does really put me to sleep
